What Happens to Your Home Equity When You Sell for Cash?
Equity is the difference between what your home is worth and what you owe on it. When you sell, that equity is what you walk away with after the mortgage is paid out and closing costs are covered.
Three Scenarios: What You Walk Away With
High equity (no mortgage or nearly paid off): If your home is worth $600,000 and you owe $50,000, you have $550,000 in equity going in. After your lawyer pays out the mortgage and deducts closing costs, you receive the balance.
Moderate equity: If your home is worth $600,000 and you owe $350,000, your equity is $250,000. The mortgage is paid out at closing and the remaining proceeds come to you.
Low equity: If you owe close to the property value, the proceeds after payout will be smaller. In some cases, selling now avoids additional months of carrying costs that would erode whatever equity remains.
How You Receive Your Money in Ontario
In Ontario, all real estate closings go through lawyers. Your lawyer receives the full purchase amount from us, pays out your outstanding mortgage and any adjustments, deducts legal fees, and transfers the net proceeds to you. This happens on closing day. You do not handle cash transfers directly. Everything moves through the legal process.
Your lawyer prepares a Statement of Adjustments that itemises every dollar. The Law Society of Ontario requires that every real estate closing in the province be handled by a licensed lawyer. We cover our own legal representation. You retain and instruct your own.
How Selling a House for Cash Works in Ontario
A cash sale in Ontario follows the same legal framework as any real estate transaction. The key difference is the buyer does not need mortgage approval, which removes the financing condition and lets the deal move considerably faster.
You Need Your Own Real Estate Lawyer
Every Ontario real estate transaction requires a lawyer on both sides. Your lawyer reviews the purchase agreement, conducts a title search, prepares the transfer documents, handles the mortgage discharge, and transfers your sale proceeds on closing day. Title Transfer and Registration
When the sale closes, your lawyer registers the change of ownership through Ontario’s land registry system using Teraview, the province’s electronic land registration platform. The deed is prepared, signed, and registered on closing day. Once registered, title transfers to GTA House Buyers.
Property Tax Adjustments
Property taxes are divided between buyer and seller based on who owned the property during that tax year. If you have prepaid taxes beyond your closing date, you receive a credit. If you owe taxes for the period you owned the home, that amount is deducted from your proceeds. Your lawyer handles all of this in the Statement of Adjustments.
Mortgage Discharge
If you have a mortgage, your lender must be paid out in full and the mortgage discharged from title on closing day. Your lawyer requests a mortgage discharge statement from your lender showing the exact payout amount. That amount is paid from your sale proceeds. Your lender then registers the discharge.
One thing to confirm with your lender before closing: some mortgages carry a prepayment penalty if broken before the end of the term. This varies by lender and mortgage type and is paid from your proceeds if it applies.
What Sellers Pay at Closing in Ontario
As the seller, your closing costs typically include:
- Your real estate lawyer’s fees
- Your mortgage payout and lender discharge fee
- Property tax adjustments for the period you owned the home
- Any liens or other encumbrances registered against the property
Sellers in Ontario do not pay Land Transfer Tax. That is the buyer’s cost. In a direct cash sale with GTA House Buyers, there are no real estate agent commissions on either side.
How a Cash Sale Differs from an MLS Transaction
A traditional MLS sale typically includes a financing condition and a home inspection condition. Either can cause a deal to fall through after weeks of waiting.
